Privacy Policy

Last updated: 14 October 2026

Dolphin Swim Australia (Dolphin Swim Australia Pty Ltd ACN 138 208 081 as trustee for the Dolphin Swim Australia Unit Trust, ABN 95 706 319 134) ("we", "us", "our") runs wild dolphin swims and dolphin watch cruises in Port Stephens, NSW. We respect your privacy and handle personal information in line with the Australian Privacy Principles.

This policy explains what personal information we collect, how we use it, who we share it with, and the choices you have. It applies however you deal with us: on our website (dolphinswimaustralia.com.au), on our online booking pages (provided by Rezdy), by phone, by email, in person, or through a booking agent.

1. What we collect and how

Information you give us, when you book, buy a gift voucher, sign a waiver or contact us:

  • Name, email address, phone number, postcode and country
  • Names and ages of everyone in your booking
  • Booking details: tour, date, number of guests, special requests
  • Gift voucher details, including the recipient's name and email if you send it to them
  • Information you share about swimming ability or medical conditions, collected only with your consent and only so we can run the tour safely
  • Messages you send us by email, phone, social media or our website forms

Payment details are handled by our payment provider. We do not store full card numbers.

Information from booking agents. If you book through an agent (such as RedBalloon or a local booking office), they pass us the details needed for your booking.

Photos and video. Our crew take photos and video on tour, which we may use on our website, social media and in advertising. If you would rather not appear, let the crew know on the day or contact us, and we will do our best not to use images where you can be clearly identified (and will remove them from our own channels if already posted).

Information collected automatically when you use our website or booking pages: your IP address, device and browser type, pages viewed, how you arrived (for example from an ad or a search), and actions such as starting or completing a booking. We collect this using cookies and similar tools, explained in section 3.

2. How we use it

We use your information to:

  • Take, manage and confirm your booking or gift voucher
  • Contact you about your tour, including weather changes and cancellations
  • Keep guests and crew safe on the water
  • Answer your questions and handle feedback or complaints
  • Improve our tours, website and booking process
  • Send you news and offers (see below)
  • Measure and improve our advertising (see section 3)
  • Meet our legal, insurance and permit obligations

Marketing. We may send you emails about our tours, the season and special offers. Every marketing email has an easy way to unsubscribe, or you can contact us at any time to opt out. Opting out of marketing does not affect messages about a booking you have made.

We do not sell your personal information.

3. Advertising, cookies and analytics

Our website and booking pages use cookies and similar tools from Meta (Facebook and Instagram) and Google. These include the Meta Pixel, Meta's Conversions API, Google Analytics and Google Tag Manager. They help us understand how people find and use our website, and measure which ads lead to bookings.

Measuring our ads. When you make a booking, we tell Meta that a booking happened, with its value and booking number. To match it to an ad you may have seen, we also send your email address and phone number in hashed form. Hashing turns them into a scrambled code before they leave our systems, so Meta can match them to an account but cannot read them.

Showing ads to past customers. From time to time we may upload a hashed list of past customers' emails and phone numbers to Meta or Google. They match it to their users so we can:

  • show relevant ads to past guests (for example gift voucher offers)
  • stop showing booking ads to people who have just booked
  • find new people with similar interests

The list is hashed before upload. Meta and Google delete details that don't match, and we cannot see who matched.

Your choices:

  • Block or delete cookies in your browser settings. Parts of the site may not work as well.
  • Manage the ads you see on Facebook and Instagram at facebook.com/adpreferences.
  • Manage Google ads at myadcenter.google.com.
  • Opt out of Google Analytics with Google's browser add-on.
  • Email us to ask that your details are left out of any customer list we upload.

4. Who we share it with

We only share what is needed, with:

  • Rezdy, our online booking system
  • Our payment provider, to process payments
  • Email and website service providers (including Squarespace, which hosts our website) that help us run the business
  • Meta and Google, for advertising and analytics, as described in section 3
  • Booking agents, for bookings made through them
  • Insurers, emergency services or medical providers, if needed for safety or a claim
  • Government agencies or authorities, where the law or our permit requires it

These providers may only use your information to provide their service to us.

Overseas. Some of these providers, including Meta, Google and some software services, store or process information outside Australia, mainly in the United States. We use reputable providers and take reasonable steps to make sure they protect your information.

5. Keeping it safe

We store information in secure systems with access limited to staff who need it. We keep it only as long as we need it for bookings, safety, marketing (until you opt out) and our legal and tax records, then delete or de-identify it.

6. Children

Children join our tours with a parent or guardian, who provides their details. We do not knowingly collect information directly from children.

7. Accessing or correcting your information

You can ask to see the personal information we hold about you, or ask us to correct it. Contact us using the details below and we will respond within a reasonable time, usually 30 days.

8. Complaints

If you have a concern about how we handle your information, please contact us first and we will try to fix it. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

9. Changes to this policy

We may update this policy from time to time. The latest version will always be on our website, with the date it was last updated.
